Le retour de certains officiers sup\u00e9rieurs de la police politique de la d\u00e9cennie noire, comme les sinistres g\u00e9n\u00e9raux Djebar M’henna<\/b>, Abdelaziz Medjahed<\/b>, Abdelkader Haddad<\/b>, etc., connus pour leur implication dans des massacres de civils et de crimes contre l’humanit\u00e9 <\/b>aux postes de responsabilit\u00e9 au sein des services de \u00ab\u00a0s\u00e9curit\u00e9\u00a0\u00bb a malheureusement inaugur\u00e9 le retour des pratiques de la torture contre les militants pacifiques et pro-d\u00e9mocratie du Hirak.<\/p>\n

Face \u00e0 cette recrudescence de la pratique de la torture, attest\u00e9e par des\u00a0t\u00e9moignages de victimes<\/a>, nous nous mobilisons, alg\u00e9riennes et alg\u00e9riens de la soci\u00e9t\u00e9 civile, individuellement et collectivement, pour alerter l’opinion publique de cette d\u00e9rive et nous souhaitons que le\u00a0Comit\u00e9 contre la Torture du Haut-Commissariat aux Droits de l’Homme\u00a0<\/b>examine le cas de l’Alg\u00e9rie. En effet, l’\u00e9tat alg\u00e9rien est signataire, depuis 1989, de la \u00ab\u00a0convention contre la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants<\/b>\u00a0\u00bb qui stipule dans son article 2 :<\/p>\n

  1. Tout Etat partie prend des mesures l\u00e9gislatives, administratives, judiciaires et autres mesures efficaces pour emp\u00eacher que des actes de torture soient commis dans tout territoire sous sa juridiction.<\/li>\n
  2. Aucune circonstance exceptionnelle, quelle qu’elle soit, qu’il s’agisse de l’\u00e9tat de guerre ou de menace de guerre, d’instabilit\u00e9 politique int\u00e9rieure ou de tout autre \u00e9tat d’exception, ne peut \u00eatre invoqu\u00e9e pour justifier la torture.<\/li>\n
  3. L’ordre d’un sup\u00e9rieur ou d’une autorit\u00e9 publique ne peut \u00eatre invoqu\u00e9 pour justifier la torture.<\/li>\n<\/ol>\n<\/blockquote>\n

    Le comit\u00e9 contre la torture est charg\u00e9 de surveiller l’application de ladite convention par ses \u00c9tats parties. A cet effet, il examine p\u00e9riodiquement ces derniers. Le dernier examen de l’Alg\u00e9rie remonte au mois de mai 2008, presque 15 ans !<\/strong><\/p>\n

    Nous nous mobilisons donc afin d’alerter le Comit\u00e9 contre la torture des exactions et des actes de torture commis par les \u00ab\u00a0services de s\u00e9curit\u00e9 \u00bb, sous couvert des autorit\u00e9s politiques alg\u00e9riennes, contre les opposants pacifiques pro-d\u00e9mocratie du Hirak.<\/p>\n

    Nous mettons \u00e0 la disposition de toute personne, collectif ou association de la soci\u00e9t\u00e9 civile un mod\u00e8le de lettre (adaptable bien entendu) afin de la signer et de l’envoyer au Comit\u00e9 contre la Torture du Haut-Commissariat aux droits de l’homme \u00e0 l’adresse suivante :<\/p>\n

    Examen de l\u2019Alg\u00e9rie<\/strong><\/p>\n

    En f\u00e9vrier 2019, l\u2019Alg\u00e9rie a connu un soul\u00e8vement populaire pacifique, nomm\u00e9 le \u00ab\u00a0Hirak\u00a0\u00bb, sans pr\u00e9c\u00e9dent dans son histoire \u00e0 la suite du projet de l\u2019annonce d\u2019un cinqui\u00e8me mandat du pr\u00e9sident Bouteflika avalis\u00e9 par l\u2019arm\u00e9e. Des millions d\u2019Alg\u00e9riens, \u00e0 travers tout le pays, ont manifest\u00e9 pacifiquement pour leur dignit\u00e9 et pour l\u2019\u00e9tablissement d\u2019un \u00e9tat d\u00e9mocratique et de droit. En r\u00e9action, les autorit\u00e9s ont r\u00e9pondu par une r\u00e9pression f\u00e9roce, \u00e0 tel point que la haute commissaire aux droits de l\u2019Homme des Nations unies, Mme<\/sup>Michelle Bachelet, a exprim\u00e9, lors de la 49e <\/sup>session du conseil des droits humains de l\u2019ONU, sa pr\u00e9occupation quant aux violations des droits fondamentaux en Alg\u00e9rie\u00a0: \u00ab\u00a0En Alg\u00e9rie, je suis pr\u00e9occup\u00e9e par une augmentation des restrictions sur les libert\u00e9s fondamentales, notamment une augmentation des arrestations et des d\u00e9tentions des d\u00e9fenseurs des droits de l\u2019Homme, des membres de la soci\u00e9t\u00e9 civile et des opposants politiques<\/em>\u00a0\u00bb.<\/p>\n

    En outre, profitant de la pand\u00e9mie de la Covid-19, le r\u00e9gime promulgua des lois liberticides, notamment l\u2019article 87 bis, qui criminalisent toutes activit\u00e9s de la soci\u00e9t\u00e9 civile en les qualifiant \u00ab\u00a0d\u2019actes terroristes\u00a0\u00bb. Par cons\u00e9quent, plus de 9800 interpellations<\/strong> par la justice et plus de 300 d\u00e9tenus d\u2019opinion<\/strong> qui croupissent actuellement dans les prisons. Cette vague de r\u00e9pression a touch\u00e9 toutes les franges de la population\u00a0: enfants mineurs, handicap\u00e9s, personnes \u00e2g\u00e9es, femmes, etc. Elle s\u2019est aussi accompagn\u00e9e d\u2019actes de torture<\/strong> comme en t\u00e9moignent les nombreuses d\u00e9clarations des d\u00e9tenus d\u2019opinion lors de leurs proc\u00e8s [1].<\/p>\n

    Le retour de certains officiers sup\u00e9rieurs de la police politique, connus durant les ann\u00e9es 90 pour des actes de terreur et de crimes contre l\u2019humanit\u00e9, \u00e0 des postes cl\u00e9s dans la hi\u00e9rarchie des services de s\u00e9curit\u00e9, a encore accentu\u00e9 cette d\u00e9rive du r\u00e9gime et a montr\u00e9 une volont\u00e9 d\u00e9lib\u00e9r\u00e9e pour une politique r\u00e9pressive de toute la soci\u00e9t\u00e9 alg\u00e9rienne. Le bureau des droits de l\u2019Homme de l\u2019ONU a ainsi not\u00e9 : \u00ab\u00a0Face \u00e0 cette situation, le Bureau des droits de l\u2019homme de l\u2019ONU r\u00e9clame des enqu\u00eates \u00ab rapides, impartiales et rigoureuses \u00bb sur les all\u00e9gations de torture et de mauvais traitements en d\u00e9tention<\/strong>. Il demande aussi \u00e0 Alger d\u2019abroger les textes qui sont utilis\u00e9s pour poursuivre des personnes qui ne font qu\u2019exprimer leur opinion et exercent leur droit de r\u00e9union pacifique<\/em>.\u00a0\u00bb [2]<\/p>\n

    Nous, alg\u00e9riennes et alg\u00e9riens de l\u2019int\u00e9rieur du pays et de la diaspora, exprimons notre crainte du retour des pratiques de la torture et des mauvais traitements comme ce fut le cas par le pass\u00e9 (trag\u00e9die des ann\u00e9es 90, les \u00e9v\u00e8nements de Kabylie en 2001, etc.). Nous souhaitons demander respectueusement au comit\u00e9 contre la torture d\u2019examiner le cas de l\u2019Alg\u00e9rie, car le dernier examen du dit comit\u00e9 remonte au 2 mai 2008, presque 15 ans. <\/strong><\/p>\n

    Nous soulignons \u00e9galement qu\u2019en d\u00e9pit de la ratification par l\u2019Alg\u00e9rie des principales conventions internationales du Pacte international relatif aux droits civils et politiques et de la convention contre la torture en 1989, les autorit\u00e9s alg\u00e9riennes refusent \u00e0 ce jour de mettre en \u0153uvre les Constatations du Comit\u00e9. Toutes les recommandations formul\u00e9es par les experts n\u2019ont jamais \u00e9t\u00e9 mises en \u0153uvre totalement pour \u00e9radiquer la pratique de la torture.<\/p>\n

    Notre espoir est que cet examen puisse faire cesser les pratiques de la torture et surtout le sentiment d\u2019impunit\u00e9 de certains tortionnaires.<\/p>\n

    In February 2019, Algeria experienced an unprecedented peaceful popular uprising, called \u00ab\u00a0Hirak\u00a0\u00bb, following the army-endorsed announcement of president Bouteflika\u2019s fifth term. Millions of Algerians, throughout the country, demonstrated peacefully to demand the establishment of a democratic state ruled by law. The authorities responded with a severe and unjustified crackdown. The United Nations High Commissioner for Human Rights, Ms. Michelle Bachelet, expressed, during the 49th session of the UN Human Rights Council, her concern about the violations of fundamental rights in Algeria: \u201cIn Algeria, I am concerned by the increase in restrictions on fundamental freedoms, in particular an increase in the arrests and detentions of human rights defenders, members of civil society and political opponents <\/i>\u201d.<\/p>\n

    On top of this, the regime exploited the Covid-19 pandemic to enact liberticidal laws, in particular by amending article 87 bis of the penal code which now considers as acts of terrorism all the peaceful activities of human rights defenders, journalists and political activists. Consequently, we now have more than 9,800 arrests <\/b>by the courts and more than 300 prisoners of conscience <\/b>who are languishing in prisons. This wave of repression has affected people from all walks of life: minors, disabled children, the elderly, women, you name it. It has also been accompanied by acts of torture,<\/b> as evidenced by the numerous statements made by prisoners of conscience during their trials [1].<\/p>\n

    The reinstatement to key positions in the hierarchy of the security services of certain senior officers of the military police who were active during the black decade of the 1990s and who are known for their responsibility in the crimes of torture, summary executions and enforced disappearances, has further accentuated this drift of the regime, and has shown a deliberate will for a policy of generalized repression. The UN Human Rights Office noted: \u00a0\u00bb Faced with this situation, the UN Human Rights Office calls for \u2018prompt, impartial and rigorous\u2019 investigations into the <\/i>allegations of torture and ill-treatment in detention.<\/i><\/b> It also asks Algiers to repeal the texts that are used to prosecute people who only express their opinion and exercise their right to peaceful assembly.[2].
    <\/i><\/p>\n

    We, Algerians from inside the country and from the diaspora, express our fear of the return of the practices of the recent past and dread yet another tragedy like that of the 90s or the events in Kabylia in 2001. We wish to respectfully request the Committee Against Torture to examine the situation of Algeria. The last examination of this committee dates back to May 2, 2008, almost 15 years ago.<\/b><\/p>\n

    We\u2019d also point out that despite Algeria\u2019s ratification of the International Covenant on Civil and Political Rights and the Convention against Torture in 1989, the Algerian authorities have so far refused to implement the Committee\u2019s recommendations. None of the recommendations made by the experts have ever been implemented to address serious violations of human rights and in particular the systemic practice of torture.<\/p>\n

    Our hope is that this examination would put an end to the practices of torture and end the sense of impunity of the torturers.<\/p>\n
