
التضييق على الحريات النقابية في الجزائر
تعبّر عدة جمعيات وتكتلات ونشطاء جزائريون مقيمون في الخارج عن إدانتهم الشديدة
للحكم الصادر عن المحكمة الإدارية بتاريخ 28 يوليو/تموز 2026، والقاضي
بنفاذ قرار وزارة التربية الوطنية القاضي بإنهاء مهام نقابة «الكناباست»،
إثر دعوى رفعتها وزارة العمل ضدها.
ويعتبر الموقعون هذا القرار عملاً سافراً بصلة مؤسسية إلى الدولة والسلطات التي
تدّعي القانون والانتماء إليها.
وقد سبق لنقابة «الكناباست» أن نفت الاتهامات الموجهة إليها، معتبرةً أن حلّها
تمّ في غياب مؤسس قانوني صريح، وأن القرار يشكل اعتداءً صريحاً على استقلال
العمل النقابي، كما يمثل انتهاكاً للحقوق النقابية التي يكفلها القانون الوطني
والدولي، والدفاع عن حقها في النشاط.
إن هذا الحكم ليس سوى حلقة في مسار تنتهجه السلطات لتصفية كل صوت مستقل،
وتوظيف القضاء أداةً للتصفية والحسابات السياسية، وهو ما يمسّ بمصداقية
المؤسسة القضائية ويكشف عن نهج متواصل في تضييق الفضاءات النقابية والاجتماعية
والسياسية.
ويعلن الموقعون، في إطار بناء تنسيق قانوني دائم مع الهيئات النقابية والحقوقية
الدولية، ومنظمة العمل الدولية، والاتحادات النقابية الدولية، والمنظمات
الحقوقية، عن عزمهم توثيق هذه الانتهاكات ومتابعتها أمام الهيئات المختصة،
والعمل على إدراجها ضمن ملفات المساءلة الدولية تجاه الجزائر بموجب الاتفاقيات
الدولية للعمل التي صادقت عليها.
إن استمرار هذا النهج القمعي سيضع الجزائر أمام مسؤولياتها الكاملة أمام المجتمع
الدولي والهيئات الأممية، وسيترجم إلى مساءلة متصاعدة على الصعيدين الحقوقي
والدبلوماسي.
فالحريات النقابية ليست تنازلاً تمنحه السلطة، بل حقاً أساسياً مكفولاً
بالمواثيق الدولية، ولا يجوز التراجع عنه أو المساومة عليه.
نطالب جميع القوى النقابية والحقوقية الدولية بالوقوف الحازم إلى جانب العمال
الجزائريين، ورفض أي تواطؤ أو صمت أمام هذا المسار، لأن الصمت اليوم يعني
التغاضي عن انتهاكات قد تتكرر غداً بحق فئات أخرى.

Atteintes aux libertés syndicales en Algérie
Plusieurs collectifs, associations et militants algériens résidant à l’étranger expriment leur plus vive condamnation du jugement rendu par le tribunal administratif le 28 juillet 2026, ordonnant la dissolution du syndicat CNAPESTE avec exécution immédiate, à la suite d’une action intentée par le ministère du Travail avec le soutien du ministère de l’Éducation nationale. Les signataires considèrent cette décision comme un acte manifeste de répression institutionnelle, sans aucun lien avec l’État de droit auquel les autorités prétendent se conformer.
Le syndicat CNAPESTE avait auparavant réfuté les accusations portées contre lui, affirmant qu’aucun fondement juridique ni aucune base légale ne justifiaient sa dissolution. Il a qualifié cette décision d’atteinte flagrante à l’indépendance de l’action syndicale et a annoncé son intention d’épuiser toutes les voies de recours, tant nationales qu’internationales, afin de défendre son droit à exister et à exercer ses activités.
Ce jugement ne constitue que le dernier épisode d’une politique systématique menée par les autorités pour éliminer toute voix indépendante et instrumentaliser la justice comme un outil de règlement de comptes politiques, au lieu d’en faire la garante des droits et des libertés.
Cette instrumentalisation politique de la justice porte atteinte à la crédibilité même de l’institution judiciaire et révèle une stratégie méthodique visant à restreindre les espaces de liberté syndicale, sociale et politique.
Les signataires annoncent le lancement immédiat d’un cadre juridique et de coordination permanent avec les organisations syndicales et de défense des droits humains internationales (Organisation internationale du Travail, fédérations syndicales internationales et organisations de défense des droits humains), afin de documenter cette violation, d’en assurer le suivi devant les instances compétentes et de veiller à son inscription parmi les dossiers relatifs au respect, par l’Algérie, de ses engagements découlant des conventions internationales du travail qu’elle a ratifiées.
La poursuite de cette politique répressive placera l’Algérie face à l’ensemble de ses responsabilités devant la communauté internationale et les institutions des Nations unies. À défaut d’un changement de cap, elle se traduira par une mise en cause croissante sur les plans des droits humains et de la diplomatie. La liberté syndicale n’est pas une concession accordée par le pouvoir ; c’est un droit fondamental garanti par les instruments internationaux, qui ne saurait faire l’objet d’aucun recul ni d’aucune négociation.
Nous appelons l’ensemble des organisations syndicales et des défenseurs des droits humains à travers le monde à se tenir immédiatement et résolument aux côtés des travailleurs algériens et à rejeter toute forme de silence ou de complaisance envers une politique de musellement des voix indépendantes. Se taire aujourd’hui reviendrait à fermer les yeux sur une violation qui pourrait demain frapper d’autres catégories de la société.

Crackdown on Trade Union Freedoms in Algeria
Several collectives, associations, and Algerian activists living abroad strongly condemn the ruling issued by the Administrative Court on 28 July 2026, ordering the dissolution of the CNAPESTE union with immediate enforcement, following a lawsuit filed by the Ministry of Labour with the support of the Ministry of National Education. The signatories consider this decision to be a blatant act of institutional repression, bearing no resemblance to the rule of law that the authorities claim to uphold.
CNAPESTE had previously refuted the allegations brought against it, asserting that there was no legal basis or legitimate justification for its dissolution. The union described the ruling as a direct attack on trade union independence and declared its determination to exhaust all available legal remedies, both domestically and internationally, to defend its right to exist and operate.
This ruling is merely the latest step in a systematic policy pursued by the authorities to eliminate every independent voice and to use the judiciary as an instrument for settling political scores, rather than as a guarantor of rights and freedoms. Such political instrumentalization of the justice system undermines the credibility of the judiciary itself and reveals a deliberate strategy aimed at restricting union, social, and political freedoms.
The signatories announce the immediate establishment of a permanent legal and coordination framework with international trade union and human rights bodies (the International Labour Organization, international trade union federations, and human rights organizations) to document this violation, pursue it before the relevant international mechanisms, and ensure that it is included in international accountability processes
concerning Algeria’s obligations under the international labour conventions it has ratified.
The continuation of this repressive policy will place Algeria before the international community and the United Nations with full responsibility for its actions. Unless this course is reversed, it is likely to result in increasing scrutiny and accountability at both the human rights and diplomatic levels. Freedom of association and trade union rights are not privileges granted by the authorities; they are fundamental rights guaranteed by international instruments and cannot be curtailed or negotiated away.
We call on all international trade union organizations and human rights bodies to stand immediately and firmly alongside Algerian workers and to reject any silence or complicity with policies aimed at silencing independent voices. Remaining silent today would mean overlooking a violation that could tomorrow be inflicted upon other groups as well.
